The 2024 Retirement Security Rule Was Vacated: What Remains in 2026
The Department of Labor’s 2024 Retirement Security Rule was vacated in March 2026. The earlier investment-advice fiduciary definition remains operative, while securities-law duties and applicable state insurance standards continue to govern their respective relationships. For a rollover or annuity recommendation, identify the provider’s capacity and request a written comparison of costs and alternatives.
As of November 3, 2026, DOL’s rule page identifies the vacatur and links to the March 20, 2026 Federal Register notice. The notice explains the court judgments and operative regulatory text. DOL status page.
What happened to the 2024 rule
DOL’s notice records final judgments dated March 12, 2026 in the Eastern District of Texas and March 17, 2026 in the Northern District of Texas. It explains that the 2024 rule had been stayed and never became effective; the earlier five-part-test regulation therefore had not actually been replaced. Federal Register vacatur notice.
The notice also republishes the operative PTE 2020-02 exemption text without the 2024 amendments. It distinguishes that operative exemption from invalidated preamble interpretations. Do not assume that an older FAQ or summary quoting the preamble still accurately describes the governing interpretation.
DOL’s March 18 announcement describes the administrative action following the court decisions. Read it with the published notice to identify which text and exemption provisions currently apply. DOL announcement.
How the five-part investment-advice test works
For the regular-advice route, DOL describes five elements: advice about investment value or recommendations to invest, buy, or sell; delivery on a regular basis; a mutual agreement or understanding; advice serving as a primary basis for plan investment decisions; and advice individualized to the plan’s needs. Fee or other compensation is also part of the statutory setting. DOL Technical Release 2026-01.
Apply all five elements to the relationship, including how the advice is used and what the parties understood. The regulatory text also addresses discretionary authority or control. A provider should explain its status from the actual arrangement, including any relationship surrounding an individual recommendation.
Ask: “Are you acknowledging fiduciary status for this retirement recommendation, and under which law and relationship?” Request the answer in writing alongside the recommendation, service agreement, and compensation disclosures.
Securities-law protections remain distinct
An investment adviser’s fiduciary duty under the Advisers Act includes duties of care and loyalty. The SEC’s interpretation addresses advice in the client’s best interest, conflicts, and the scope of the advisory relationship. That framework was not erased by the retirement-rule vacatur. SEC fiduciary interpretation.
Broker-dealers’ Regulation Best Interest applies when they make covered securities recommendations to retail customers, including account and rollover recommendations. It requires more than disclosure alone and does not permit the broker to place its interests ahead of the customer’s. The SEC describes disclosure, care, conflict-of-interest, and compliance obligations. SEC Reg BI guide.
| Relationship or transaction | What to clarify |
|---|---|
| Investment advisory engagement | Scope of advice, monitoring, fees, and fiduciary obligations |
| Broker’s securities or account recommendation | Reg BI obligations and the capacity in which the person acts |
| Retirement-plan advice | Whether the ERISA/Code fiduciary definition applies to the facts |
| Insurance annuity sale | Product type, state insurance requirements, and any securities-law coverage |
A firm or individual can operate in more than one capacity. Ask which role applies to the recommendation and which agreement governs the account. Registration is a starting point, not a substitute for reading the scope of the engagement.
Identify the annuity type and applicable regulator
The SEC distinguishes fixed indexed annuities, which it does not regulate as securities, from registered index-linked and variable annuities, which are securities. State insurance requirements apply to annuity sales, and the product and recommendation determine any securities-law coverage. Indexed annuities, annuity comparison.
NAIC’s annuity model provides a best-interest framework for state adoption. A model is not itself the law in every state. CFP Board’s comparison explains that its own standards impose a fiduciary duty while the NAIC model does not. Check the law applicable to the actual sale. NAIC overview, CFP Board comparison.
Ask for the contract’s surrender schedule, guaranteed and nonguaranteed features, rider costs, compensation, and the effect of early withdrawals. A fiduciary label also does not mean every commission is categorically forbidden; applicable prohibited-transaction exemptions and other conditions require their own analysis.
Request a rollover comparison before authorizing it
The SEC staff’s account-recommendation bulletin says a rollover recommendation should address both the move itself and the proposed destination. It identifies factors including costs, services, investment options, withdrawal access, required distributions, creditor protection, and employer stock. SEC rollover-analysis guidance.
Use those factors to request a written comparison of keeping the current account and the available alternatives. The comparison should use your actual plan disclosures and the destination’s proposed fees, not an assumption that every IRA is cheaper or offers better service.
For a hypothetical $500,000 account, a plan charging 0.20% annually costs $1,000 on a constant balance. An IRA charging 0.80% for advice plus 0.10% in fund expenses costs $4,500, a $3,500 annual difference before other charges, taxes, or balance changes.
Ask which additional services, access, or features justify the $3,500 annual difference for this household. Put those deliverables beside any employer-plan benefits being lost, including relevant withdrawal or creditor-protection features. The comparison should support both the move and the destination.
Verify the provider and preserve the recommendation
Check the firm and individual through Investment Adviser Public Disclosure and FINRA BrokerCheck, as applicable. For an insurance sale, use the state insurance regulator’s license records as well. Read disclosed events and their outcomes rather than treating every complaint as a proven violation.
Keep the written recommendation, fee estimate, product documents, and your questions with the replies. If the provider’s explanation of its role changes between the sales conversation and the agreement, resolve that discrepancy before proceeding.
For a large transaction, consider a separately priced second opinion on the recommendation, alternatives, fees, and lost benefits. Define the reviewer’s assignment and verify their relevant experience. Use the resulting analysis to resolve specific uncertainties before authorizing the move.
Treat future rulemaking as a separate development
Track future developments through DOL’s rule page and published legal text. Record whether each development is a proposal, final rule, compliance deadline, stay, or vacatur. Apply the currently operative provisions to the recommendation under review.
The immediate investor decision remains specific: who is recommending what, under which obligation, at what cost, and with which alternatives? Those questions remain necessary even when a provider is subject to a fiduciary standard.
